Several countries in the EU, as well as some jurisdictions outside of the EU, have textiles EPR laws at different stages of development

Textiles waste is a rapidly growing waste stream, and historically much of this waste has gone to landfill. Textiles EPR legislation is expanding rapidly in the European Union to address this, and the laws currently in place and those coming into force soon follow similar steps to those required for WEEE, Batteries, and Packaging.

Currently, textiles producers placing products on the market in France, The Netherlands, Latvia, and Hungary are obligated to fulfil their compliance obligations in these countries, according to the national Textile waste EPR laws in place.

Regulation 2024/1781

The new EcoDesign Regulation (ESPR) 2024/1781, which scopes in Textile Waste, is in force from 18 July, 2024 onwards

The ESPR establishes a ban on destruction of specific unsold textiles categories, and mandates textile products to have a Digital Product Passport by a date to be determined in 2027~2028 . Delegated Acts currently in development will define specific Textile Producer EPR requirements and obligations, and establish implementation timelines which will dramatically expand producer obligations for textiles end of life waste management.

Due to the current individual country approach, obligated textiles products vary broadly, with clothing and apparel textiles at minimum typically in scope, contributing to the complexity of textiles EPR compliance for producers. Reporting formats vary, so it is important for textile producers to organise their data in preparation for their waste submissions. It is anticipated that once all of the requirements of the ESPR and Delegated Acts are in force that product scope will expand beyond these two categories and be consistent across the EU.
